By accessing or using this website, you agree to be bound by these Terms, which apply to your use of the website operated by Scala Luxury, a designer and manufacturer of Art pieces, Accessories and Furniture, including the website located at www.scalaluxury.com.

If you do not agree with these Terms, please do not access or use this website, our services, or place orders with us. Continued use of the website or our services constitutes acceptance of these Terms.

Scala Luxury may update or revise these Terms at any time by posting the revised version on this website. When changes are made, the Last Updated date may be updated accordingly. Your continued use of the website or services after any changes have been posted means you accept the revised Terms. We recommend reviewing this page periodically so you remain informed of the terms that apply to your use of our website and any purchases made through Scala Luxury.

Order Processing and Payments

Customers are required to register an account with us before placing orders. It is your responsibility to keep your contact, billing, and shipping information accurate and up to date. Scala Luxury is not responsible for errors, delays, incorrect documents, or shipping issues caused by inaccurate or outdated customer profile information.

Customer account information and order history may remain stored on our website until updated or removed by the customer, subject to our internal policies and applicable law.

Before an order is placed, Scala Luxury will provide a written quote by email. Quotes may include product pricing, product details, lead times, sidemarks, payment terms, and other information relevant to the order. Please review all details carefully and confirm that the quote matches the information on your purchase order. Quotes are valid for 30 days from the date issued unless otherwise stated in writing. If the quote has expired, please contact Scala Luxury to confirm whether pricing, lead times, and availability remain valid before proceeding.

Back orders require a non-refundable deposit of at least 50% of the invoice value unless full payment is made at the time of order. Stock items require full payment when ordered. For back orders and custom orders, Scala Luxury will provide updates by email or phone during production when appropriate. Once an order arrives at our warehouse, the remaining balance becomes due. Scala Luxury may issue the balance invoice prior to arrival to allow time for payment processing. Upon request, we may assist in coordinating with your preferred shipper for pickup.

Custom orders require a non-refundable deposit of at least 50% of the invoice face value. The balance becomes due upon arrival at our warehouse. Custom orders must be supported by clear, professionally approved drawings, dated and signed by the customer. Scala Luxury may provide such drawings for approval when applicable. If a production or delivery timeframe has been quoted, the official start date is based on receipt of the required deposit and approval of all required drawings, samples, specifications, or other order materials.

Prompt communication during order placement and production is essential. If Scala Luxury requires clarification and does not receive a response within a reasonable timeframe, including within 24 hours when urgent, delivery dates may be adjusted accordingly. Customer-requested changes after order placement may extend lead times and may affect pricing. Revised invoices and revised signed drawings for approval may be required before production continues.

Scala Luxury is not responsible for delays, production issues, or errors resulting from incorrect drawings, unclear information, misleading specifications, delayed approvals, or details that may reasonably be misinterpreted.

Scala Luxury accepts payment by company check, ACH transfer, or wire transfer.

Orders ready for delivery may remain in Scala Luxury's warehouse for up to 30 days unless otherwise agreed in writing. After 30 days, Scala Luxury reserves the right to charge storage fees and monthly late fees of up to 3% compounded on unpaid balances. If merchandise remains in storage for more than 90 days due to unpaid balances, failure to arrange pickup, or other unreasonable delay, Scala Luxury may take further action, including auctioning or otherwise disposing of the merchandise to recover product costs, storage fees, and related expenses. In such cases, no refund or credit will be issued.

All orders are subject to acceptance by Scala Luxury. Orders will be confirmed electronically or by email after receipt of the customer's purchase order and required deposit.

Scala Luxury may cancel an order if manufacturing, business, supply, credit, or other conditions make fulfillment impractical or inadvisable in Scala Luxury's judgment.

Unless otherwise stated in writing, product prices are F.O.B. Los Angeles, Scala Luxury warehouse, or EXW overseas factory, depending on the order terms shown on the quote or invoice and the most practical business conditions at the time. Special packaging, crating, or handling is not included unless expressly stated.

Scala Luxury reserves the right, without liability or prior notice, to revise, delay, or cancel orders when manufacturing, shipping, import, customs, container, natural disaster, or other circumstances beyond Scala Luxury's control require such action.

Product Availability and Lead Times

In-stock items are available for shipment after internal processing and staging, which generally takes approximately 1-2 weeks.

Lead times for back orders or custom orders are typically approximately 14 weeks unless otherwise stated in writing. Please confirm availability and lead time with Scala Luxury before placing an order.

Scala Luxury reserves the right, without liability or prior notice, to revise, discontinue, or remove products from its catalogs, website, or offerings.

Lead times stated on quotes or invoices for back orders are subject to a 30-day grace period due to possible customs clearance, container delays, freight delays, production conditions, or other factors beyond Scala Luxury's control.

Lead times are based on the issue date of the quote or invoice, receipt of payment, approval of technical drawings, approval of color samples, and receipt of any other materials or information required to finalize the order. Scala Luxury reserves the right to extend or revise lead times if manufacturing, supply, business, or shipping conditions make the originally quoted timeframe impractical.

Shipping

Scala Luxury operates on a business-to-business trade basis. Our products are intended for trade use only. Shipping and delivery arrangements are the responsibility of the customer unless otherwise agreed in writing.

Scala Luxury does not arrange residential or home deliveries and does not provide customer service for deliveries to end users. If merchandise must be delivered directly to an end user, the customer is responsible for selecting, coordinating, and scheduling a delivery company at the customer's own risk.

Merchandise picked up from Scala Luxury's warehouse or released under EXW factory terms must be inspected by the carrier at pickup. Once the carrier signs the Bill of Lading indicating receipt in first-rate condition, title to the merchandise transfers to the customer. Scala Luxury is not responsible for shipping damage, lost goods, delays, or claims arising after the merchandise has been released to the carrier.

Any damage discovered upon delivery must be noted on the carrier's Proof of Delivery before signing. Claims must be filed directly and immediately with the shipping company. We strongly recommend photographing the merchandise while it is still with the carrier and in the presence of the carrier's staff. Photos taken on the carrier's truck or during unloading are often the strongest evidence that damage occurred before the customer accepted possession. If damage appears severe or beyond repair, the customer may choose to reject the delivery at their discretion.

If shipping damage or another claim arises after merchandise has been picked up from Scala Luxury's facility, the customer remains responsible for making timely payment to Scala Luxury according to the invoice terms. Payments may not be withheld while the customer awaits settlement from a freight carrier, third-party shipper, insurance company, or other outside party.

Scala Luxury does not prepay domestic shipping charges for customers. All shipments are freight collect or prepaid directly by the customer to the carrier, without exception.

International air freight estimates and quotes exclude taxes, duties, customs fees, storage fees, destination charges, clearance fees, and any other charges that may arise in the destination country.

For liability reasons, Scala Luxury does not formally recommend carriers. However, we may assist customers by requesting freight quotes on their behalf. Any quote provided by a third-party shipping company is passed along to the customer for convenience only, is non-binding, and does not create liability for Scala Luxury. Scala Luxury is not responsible for the accuracy, validity, service terms, insurance coverage, or policies of any third-party carrier. Customers are responsible for confirming directly with the carrier that the service, insurance, delivery terms, and conditions meet their requirements.

Product and Warranty

Scala Luxury warrants that its products will be free from defects in workmanship for one year from the date of sale, except for discounted items, irregular items, prototypes, floor samples, overstock items, or any merchandise sold as is.

Scala Luxury products are handmade. Small variations in dimensions, finish, color, materials, construction, and details should be expected. Measurements may vary from information shown in catalogs, quotes, invoices, Bills of Lading, drawings for approval, or other documents.

Because our products are crafted by hand, natural characteristics, irregularities, and variations are part of the product and should not be considered defects. Scala Luxury reserves the right to make design, construction, or production adjustments when necessary, without prior notice. Some products include natural materials that may expand, contract, darken, lighten, or otherwise change based on environmental conditions, including humidity, temperature, sunlight, and air exposure.

Scala Luxury does not provide warranties for products exposed to extreme weather, excessive heat, cold, humidity, improper handling, improper transport, prolonged sunlight, direct daylight exposure near large windows, or proximity to air conditioning or heating vents. Materials such as parchment, goatskin, shagreen, leather, and high-gloss lacquer are particularly sensitive to UV light and environmental conditions. Customers should place and maintain such pieces carefully to preserve their appearance and longevity.

Natural materials including goatskin, shagreen, lizard skin, parchment, and leather may vary in color, tone, pattern, and texture. These materials may also change over time. Samples, catalogs, and photographs are representative only and may not precisely match finished merchandise. A variation of approximately 20% in color, tone, or appearance should be expected for Scala Luxury products using natural materials. Skin placement, pattern size, and surface layout may also vary due to the size of available skins and the dimensions of each item.

Scala Luxury takes great care in the design and construction of its furniture and applies high-quality standards and proper construction methods. However, Scala Luxury does not offer a money-back guarantee. Any return must be approved in writing by Scala Luxury before merchandise is returned.

Discounted Items Purchased During Sales Events

From time to time, Scala Luxury may offer sales events featuring irregular items, prototypes, floor samples, overstock items, or other discounted merchandise. These items may not meet the exact standards of regular production merchandise but are offered in acceptable condition at significantly reduced prices. Customers should expect minor imperfections, irregularities, signs of handling, or variations consistent with discounted merchandise.

Dimensions provided for sales event items are approximate and generally reflect the largest overall measurements. If exact measurements are required, please contact Scala Luxury before purchase and we will provide additional information when available. Customers may also request detailed photos before purchasing to better understand the item's condition.

Shipping and transport charges are not included and remain the responsibility of the customer. Title to merchandise passes to the customer when the carrier accepts delivery from Scala Luxury's facility and signs the Bill of Lading. Scala Luxury is not responsible for shipping damage, lost goods, carrier delays, or claims that must be filed with the carrier.

If discounted merchandise is received damaged, the customer must note the damage on the carrier's Proof of Delivery before signing and file a claim directly with the shipping company at the time of delivery. We recommend taking photos while receiving the merchandise and while the carrier's staff is present. Photos taken before the merchandise is removed from the truck can provide important evidence that the damage occurred before the customer accepted possession. If damage appears beyond repair, the customer may choose to reject the delivery at their discretion.

All sales event purchases are final. Discounted items are sold in as is condition. Scala Luxury does not accept returns for discounted merchandise, and discounted products are not covered by warranty unless expressly stated in writing.

Copyrighted Materials and Unauthorized Use

All content on the Scala Luxury website, including images, photographs, product designs, text, graphics, logos, catalogs, and other materials, is owned by Scala Luxury or used with permission and is protected by applicable copyright, trademark, and intellectual property laws.

You may not use Scala Luxury website content or images for commercial purposes without prior written permission from Scala Luxury. You may not publicly display, reproduce, sell, distribute, modify, publish, advertise, or otherwise use Scala Luxury content to promote products or services without written authorization.

You may not use the Scala Luxury name, product images, designs, or related materials in connection with any product, promotional material, commercial activity, website, publication, or advertising without prior written permission from Scala Luxury.

If you wish to use Scala Luxury content for any purpose beyond permitted personal or internal trade reference use, including commercial publication, marketing, website display, editorial use, or high-resolution image reproduction, you must obtain written permission from Scala Luxury in advance.

Permission requests and inquiries, including requests for high-resolution digital images or other formats, should be sent to Scala Luxury's office.

Typographical Errors

If a product is listed with an incorrect price, description, specification, availability status, or other information due to typographical, technical, pricing, or administrative error, Scala Luxury reserves the right to refuse, revise, or cancel any order placed for that product, whether or not the order has already been confirmed.

Governing Law

These Terms and any related terms and conditions of sale shall be governed by and enforced in accordance with the laws of the State of California.

The customer agrees that any dispute arising from or relating to these Terms, the website, any order, or any transaction with Scala Luxury shall be litigated exclusively in the courts of the State of California. Venue shall be in the Superior Court of Los Angeles County, California.
